Please read these Terms and Conditions (hereby referred to as “T&C”) carefully before using the CB Website (and CB Store websites) operated by CB. This document sets out the terms and conditions between Carbon Black – Entertainment Design Workshops, hereby referred to as „CB“, “we” or “us”, represented and run by Silvia Wipfler, and you (hereby referred to as “you” or “participant”) when you use our website (www.carbon-black.design), purchase a ticket or register for any present or future activity organised by CB, attend any event organised by CB, make a purchase in our online store, use any other present or future service provided by us or visit or purchase from any other business affiliated with CB, whether or not included in the CB website. You are agreeing to comply with and be bound by these terms and conditions. CB reserves the right to change these terms and conditions at any time and without prior notice. Any amended terms and conditions will be posted to this website: www.carbon-black.design
2. GENERAL CONDITIONS
Attendees of CB Events must be at least 18 years old to access CB events.
3. PURCHASING TICKETS
Places in CB workshops are strictly limited. Therefore participants are obliged to pay their tickets within 7 days after purchase, otherwise they lose their seat. If CB receives payment later than that and there are still seats left, the person still gets a seat. If CB receives payment later than that and the workshop is sold out, CB refunds the ticket price minus a service fee of 5 percent using the same payment method that was used to purchase the ticket.
During the purchase and checkout process, your ticket is not reserved. It will only be reserved once you made the purchase.
a. Payment Options:
CB accepts PayPal and bank transfer. We might add more options in the future.
PayPal: When somebody wants to pay with PayPal, they need to choose the ticket type “PayPal” when they register for an event. A person’s spot in the workshop is automatically secured as soon as the purchase and payment are confirmed.
Bank transfer: When somebody wants to pay with wire transfer, they need to select the ticket type “Bank Transfer”and wire the money to our bank account within 10 days. A person’s spot is reserved for 10 days and they are fully responsible to pay in time. If CB doesn’t receive the money in time, the person who purchased the ticket automatically loose their seat. If we receive the money later and spots are still left, the person gets a place and can attend the event. If we receive the money later and the workshop is sold out by then, the person who purchased the ticket receives a 95% refund. Due to bank charges and the time it takes to return the money, CB charges a service fee of 5%.
The ticket price “Bank Transfer” says 0€, because we receive payment via bank transfer. This means that the full ticket price still needs to be paid (with wire transfer)!
b. Waiting List:
There is no waiting list at the moment.
c. Reselling Tickets:
Tickets purchased are for your own personal use or that of your business and may not be re-sold or transferred for commercial gain under any circumstances. In case of resale or attempted resale of tickets (or any other breach of these T&C), CB reserves the right to ban responsible individuals from any current and/or future events. In case of T&C violation CB does not grant any form of refund whatsoever.
d. Personal Data Collection:
If you purchase a ticket for a CB workshop and/or register for a CB event, you will receive the following automatic communications per email:
- Registration/order confirmation
- Purchase confirmation
- Payment request
Newsletters and mailing lists:
People who register for CB events will be added to the CB mailing list and will receive newsletters. CB newsletters inform you about new CB workshops and events, changes to CB workshops and related events, partner events, surveys, special offers, or other important information regarding CB and CB events. You may unsubscribe at any time. However, please keep in mind that CB uses email communication to inform you about important changes or cancellations of events you registered for. These emails are necessary to keep you up to date and are for your own benefit. Therefore you acknowledge to unsubscribe at your own risk.
5. RETURN POLICY
If participants want to get a refund, the following conditions apply:
- 100% refund: 61 days prior to the workshop or more
- 50% refund: 60 – 45 days prior to the workshop
- 0% refund: 44 days prior to the workshop or less
CB reserves the right to charge a service fee of 5% of the workshop’s full price, regardless the situation. Participants have the option to find someone who takes their place instead. However, the person replacing them must also meet the course requirements. Please contact CB when you want to give your ticket to someone else: email@example.com
If a workshop has to be cancelled by CB for any reason, participants receive a full refund of the purchase price and no service fee will be charged.
a. How to claim a refund
Participants can claim a refund via email firstname.lastname@example.org. CB will respond within 7 business days. Participants are responsible for ensuring that CB receives their refund claims. Therefore CB advises participants to send a read confirmation. If participants have not received an answer from CB within 7 business days, CB kindly asks participants to contact CB again. CB cannot be made liable for any damages or incurred costs that are a result of failed communication.
b. How the amount of refund is calculated
The amount of money that is returned depends on the day the email has been received by CB. CB is located in Austria, therefore CET/CEST applies.
c. How refunds are paid
CB refunds money received using the same payment method participants used for purchasing their ticket. CB agrees to return the money within 21 days, starting with the day CB has informed participants per email that CB accepts their claim for refund.
d. Group refunds
For group refunds the same conditions apply as for single ticket purchases.
6. CHANGES & CANCELLATION
CB agrees to only cancel workshops due to incidents and/or circumstances CB has no control of:
- Not enough participants
- The instructor has to cancel and no replacement can be found
- Danger to life and limb
- Force of nature
- Conditions at the venue make it impossible to host a workshop and no replacement can be found
- No CB employees, volunteers and or affiliates are available for overseeing a workshop
If a workshop has to be cancelled, CB grants participants a full refund of their ticket price. However, CB cannot be made liable for any damages or incurred costs that are a result of cancelled workshops (e.g. travel expenses etc.).
a. Not enough participants
CB workshops requires a minimum number of participants to take place. This number may vary from workshop to workshop and is indicated in the description of each workshop on the CB website. CB reserves the right to cancel the workshop 1 week before the start date if there are not enough participants. CB agrees to inform participants as soon as possible before start date if a workshop has to be canceled due to a lack of participants.
b. Class changes
CB reserves the right to cancel, change, and create new activities for CB Events. Any cancellations, changes, or new activities will be posted on the CB website. CB will also inform participants via email.
CB reserves the right to make changes to workshops if necessary. These changes can affect especially, but not exclusively, the schedule, venue, instructor, content and/or places visited in the course of a workshop. CB will only make such changes if circumstances dictate it and will inform participants as soon as possible on the CB website and via email. When changes are made to a workshop, CB does not grant any refunds other than stated in section XY, unless the instructor is replaced.
c. Instructor is replaced/has to cancel
It can happen that instructors fall ill or have to cancel because of other circumstances.It can happen that instructors fall ill or have to cancel because of other circumstances. If this is the case, CB will try to find a suitable replacement if possible. If CB cannot find a suitable replacement in time, CB is forced to cancel a workshop. In this case CB will announce it on the CB website and will also inform participants as soon as possible via email.
If a replacement has been found, CB will notify participants about such changes as soon as possible. CB understands that participants select workshops because of certain instructors. Therefore CB grants a 50% refund to people who want to cancel their purchase if the instructor is replaced 44 days prior to the event.
CB cannot be made liable for any loss, incurred costs and/or damages that are caused by by any form of changes or the cancellation of a workshop.
7. SITE CONTENT
The content of this site and related products is either owned by CB or is owned by third parties and used under license by CB. You are not granted any license to use this content and will not reproduce, transmit, distribute, display, modify, create derivative works of, or mark other products or services with this content.
CB makes no warranties or representations as to our site’s accuracy and specifically disclaims any liability or responsibility for any errors or omissions in the content on our sites.
Neither we nor our affiliated companies, nor any other party involved in creating, producing, or delivering the site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or inability to use or access, the site and our services. Furthermore, neither we nor any third-party content provider make any warranty with respect to any content, information, services, or products provided through or in conjunction with the site.
This site and the related products and services are offered on an “as is” and “as available” basis, disclaiming all warranties, including specifically the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. CB does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.
You agree that the use of the site is entirely at your own risk.
8. PERSONAL PROPERTY DAMAGE
CB and its affiliates are not liable for any personal property that is brought to a CB event. CB and its affiliates will not be liable for any loss, theft and/or damage to personal property of instructors and/or participants howsoever caused. Participants and instructors confirm that they bring personal property to a CB workshop and/or related events at their own risk. Therefore CB advises people to not bring unnecessary valuable items or excessive amounts of cash.
All rights, particularly related to trademarks, copyrights, inventions and industrial property rights, with all rights to programs, documents and information, title and interest, especially in and to CB‘s brand features and sites, and IP rights shall rest exclusively with CB. CB trademarks and intellectual properties may not be used in connection with any product or service that is not affiliated with CB or offered by CB itself, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits CB. All other trademarks not owned by CB or any of its affiliates that appear on this site are the sole property of their respective owners, who may or may not be affiliated with, connected to, or sponsored in any way by CB.
Any unauthorized reproduction, publication, further distribution or public exhibition of materials provided at CB workshops, in whole or in part, is strictly prohibited.
a. Content created during CB workshops
The rights to content created during CB workshops belong to their creators. However, if objects, images or anything else is copied for educational purposes, the rights remain solely with the creator of the content.
b. Plagiarism claims
Plagiarism claims will fall completely on the individuals who publish their creations and/or a photographs thereof on any platform, digital and/or analogue, or distribute, sell, reproduce these creations or make them publically available in any form. When in doubt, participants may ask the instructor during the workshop or contact CB when the workshop is over. Neither CB nor the instructor can be made liable for any copyright infringements caused by participants.
This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of CB. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CB without express written consent. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page www.carbon-black.design or any of CBs’ social media sites so long as the link does not portray CB, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any CB logo or other proprietary graphic or trademark as part of the link without express written permission.
Whenever the term “recording(s)” or the corresponding verb “to record” in any of its inflections is used in these T&C, it refers to recordings of any kind, especially, but not exclusively, to: photos, film and/or audio recordings.
a. Recordings by CB
Participants and/or instructors of CB workshops acknowledge and agree that CB records before, during and after workshops. Recordings may be done by CB, CB affiliates, CB employees, CB volunteers or third parties (e.g. freelance photographers) hired by CB. These recordings are used for promotional or educational purposes. CB will share and/or display them on the CB website, CB’s social media channels, in newsletters and other digital communication such as press releases or presentations. Participants and instructors automatically give CB permission to display and/or share recordings as stated above.
b. Recordings by instructors and/or participants
Participants and/or instructors of CB workshops may record before, during and after workshops, unless recording is prohibited. They may also display and/or share recordings for non-commercial purposes on their social media channels, blogs, websites and/or print them, unless the displaying and/or sharing is prohibited. If instructors and/or participants make recordings of other peoples’ artwork, they are not allowed to falsely claim to be the creator and/or copyright owner of such artwork and are responsible for giving credit to the creator. They are further not allowed to falsely claim to be the creator and/or copyright owner of any logo, trademark or any other form of intellectual property that is visible on recordings made before, during or after CB workshops.
c. Permission to use participants’ and/or instructors’ recordings
By participating in or lecturing at CB workshops, participants and/or instructors give CB permission to use their recordings for promotional purposes. CB does not claim ownership of participants’ and/or instructors’ recordings.
11. LEARNING SUCCESS
CB tries their best to create a workshops which offer a successful learning environment for participants. CB does not guarantee participants any learning success and improvement of their artistic skills. Participants are solely responsible for carrying out the instructor’s directives.
CB attempts to be as accurate as possible. However, CB does not warrant that descriptions, instructions or any other content provided in the course of a CB workshop is accurate, complete, reliable, current, and/or error-free.
12. CODE OF CONDUCT
Participants and/or instructors confirm to abide rules, regulations and/or T&C of third parties such as museums, venues, exhibitions and restaurants.
They further confirm to observe house rules of venue and places visited during CB workshops.
Comments during workshops or events should not be of a negative or condescending tone or of no constructive nature in regards towards others students,workshop layout or instructors. You can direct any suggestions or constructive criticism directly to the proper channels. If you have any suggestions or having any issue with the workshop, instructor, students or any activity related to the workshops please address them to a present staff member or to: email@example.com
Participants that repeatedly ignore this clause will put themselves at risk of being excluded from the current or future workshops and activities. CB reserves the right to exclude participants before or during a workshop from CB events. CB also reserves the right to ban participants from future workshops. Excluded participants do not receive any form of refund or compensation. CB may extend, shorten or reverse a ban any time.
By accepting these T&C you agree to not use CB workshops or events to:
- create or make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable
- harm participants in any way
- “stalk” or otherwise harass another
- and/or impersonate any person or entity in any way possible
13. LINKS TO OTHER SITES AND/OR MATERIALS
CB may provide you with convenient links to third party websites, social media platforms, accounts, applications, content, goods, promotions, materials, information, services or items belonging to or originating from third parties (hereby referred to as “third party content”). These links are provided as a courtesy to you. We have no control over third party websites, social media platforms, accounts, applications, software, content or third party promotions, materials, information, goods or services available on these. Such third party content is not investigated, monitored or checked for accuracy, appropriateness, or completeness by CB, and we are not responsible for any third party content accessed, posted on or installed from any ob CBs’ websites or other online appearances, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in third party content. If you decide to leave the CB website or any other od CBs’ online appearances and access, use, install, purchase or view any third party content, you do so at your own risk and you should be aware that our terms and policies, including these T&C, no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any third party to which you navigate from the CB website or any other of CBs’ online appearances.
CB does not tolerate any violations of these T&C. Therefore CB reserves the right to exclude participants before or during a workshop from CB events. CB also reserves the right to ban participants from future workshops. Excluded participants do not receive any form of refund or compensation. CB may extend, shorten or reverse a ban any time.
You agree to indemnify and hold CB and its subsidiaries, affiliates, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by you or any third party due to or arising out of your registration for and/or participation in CB workshops and events, visiting the CB website or social media appearances of CB, and/or using any other service provided by CB.
If you have a dispute with one or more of CBs’ participants, instructors, third parties, partners or any other entity you encounter through CB in any sort of way, you release CB, its affiliates, partners, employees, staff members and volunteers from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
16. LIMITATION OF DAMAGES; RELEASE
To the extent permitted by applicable law, in no event shall CB, its affiliates, employees, volunteers, staff members, representants, partners, licensors, the CB website, CB social media appearances, CB workshops and other events organised by CB be liable to you for any loss of profit, property, use, data or for any incidental, indirect, special, consequential or exemplary damages, however arising.
These T&C and your use of the CB website, its other online appearances, social media presences as well as your registration for and/or participation in CB events are governed by the federal laws of Austria.
